LEXINGTON, Ky. (LEX 18) — A man charged with DUI in connection with a fatal crash pleaded not guilty Monday.

Cecilio Reyes, 49 was charged with a DUI after a male pedestrian was hit on New Circle Road near Bryan Avenue on Saturday night. He appeared in court via a video monitor.

Police found that the pedestrian was trying to cross New Circle Road from the outer loop side when he was hit by a car driven be Reyes. A second vehicle also struck the pedestrian.

Officers conducted a sobriety test on Reyes and found that he was impaired.

Fred Peters, Reyes' attorney, says his client is not responsible in the death of the 56-year-old man who was hit.

"Somebody else definitely hit the pedestrian so we do not know what caused the pedestrian's fatality. I don't know how the autopsy will discern everything, its my understanding the other vehicle hit the pedestrian and my client stopped and called the police," Peters explained to LEX 18.

Reyes' blood alcohol test is pending. He is due back in court on Jan. 27 at 10 a.m.

The victim's identity has not yet been released.
