LOUISVILLE, Ky. (WAVE) — Police said a man was in custody Sunday morning accused of fatally shooting another man inside a Louisville Olive Garden.

Devone Frank Briggs

WAVE reports that authorities arrested and charged 30-year-old Devone Frank Briggs in the case.

Police were called out about 8:30 p.m. to reports of a shooting at the restaurant in the 4800 block of the Outer Loop at the Jefferson Mall.

Authorities said the victim was a man in his 20s who was a patron at the restaurant. The man’s identity was not immediately disclosed.

“The restaurant was pretty well populated form my understanding. There were a number of families, friends children having get-togethers, what have you, and we’re very fortunate that this was not more tragic then what it turned out to be this evening,” LMPD Spokeswoman Alicia Smiley said.

Witnesses said a fight broke before the shooting.

Police said Briggs left the scene of the shooting in a black Ford Fusion, which they found near the Jefferson Mall. Briggs allegedly was caught with marijuana.

He was charged with murder, tampering with physical evidence and trafficking in marijuana.
