DAVIESS COUNTY, Ky. (LEX 18) — No one is at fault in the case of a homeowner who claims he mistakenly shot an Owensboro police officer, according to the results of a state police investigation.

This comes after David Turley Sr. was indicted last month on first-degree assault charges.

Police say Officer Zach Morris was responding to a report of a suspicious person in October.

He reportedly chased a suspect into an alley, then Turley shot him as the officer looked over a fence.

Turley allegedly told police he thought Morris was the prowler.

Turley’s attorney says the report is not admissible in court.

Turley is due in court tomorrow.
