FRANKFORT, Ky. (LEX 18) – According to a post by the Fayette County Education Association, a ruling on the constitutionality of Senate Bill 151 could come down tomorrow.

Attorney General Beshear filed suit to stop SB 151, initially a sewer bill that evolved into the pension bill, saying it was unconstitutional. Beshear cited that the bill did not get the actuarial analysis that most bills require.

In August, Governor Matt Bevin, filed an appeal to the take the battle to the state Supreme Court, bypassing the Court of Appeals.

“Attorney General Beshear has informed KEA that the Kentucky Supreme Court will render decisions tomorrow. This means that a decision on our lawsuit with the FOP calling SB 151 unconstitutional could be rendered in the morning. KEA will go live on their Facebook page if a decision is made. This could occur at approximately 10 am ET. Please watch this page for updates!” reads a post to the organization’s social media.

Republican Gov. Matt Bevin says the law does not violate the state Constitution.

LEX 18 will update this story as more information is received.
